Redbeard Bikes Group Ride  

Participation Agreement, Release and Waiver of Claims  

I, ____________________________________ (participant’s name), in consideration of the group ride services and activities provided (the “Ride”) by Redbeard Bike Fittings LLC, DBA Redbeard Bikes or any of its owners, employees, contractors, agents or principals (taken together, “Redbeard”), make the following representations and agreements:  

  1. Representations. I represent that the bicycle and other equipment I will use during the Ride is in good working condition, and that I do not have any medical condition that would interfere with my safe participation in the Ride.  
  2. Assumption of the Risk. I understand the risks inherent in bicycling in traffic and in public areas, such as the risks of falling or of colliding with other persons, cyclists or vehicles. I voluntarily accept all of those risks and any resulting injuries, fatality, damages or other losses that may occur to me or others. 
  3. Agreement to Follow Redbeard Rules and Instructions. I agree to read and obey any instructions provided by the designated Redbeard Ride leader and all Ride rules, including without limitation that I will wear a helmet at all times while on the Ride, follow all applicable rules of the road, and in particular not ride on sidewalks or against the lawful flow of traffic. 
  4. Release and Waiver of Claims. I hereby forever release and waive any claim or right I have or in the future may have for damages, death, personal injury or loss of property caused by the negligence (other than gross negligence) of Redbeard, including without limitation negligent medical care or rescue operations. I release and waive all such claims and rights not only in favor of Redbeard, but also in favor of Ride sponsors and advertisers, owners and lessors of premises on which the Ride takes place, and the respective employees, contractors, agents, principals, affiliated companies, successors and assigns of each of them (together, the “Releasees”). I release and waive all such claims and rights on behalf of myself and any other person purporting to represent me or act on my behalf. I intend to make an unconditional release of claims and waiver of rights to the greatest extent allowed by law. 
  5. Agreement Concerning Use of My Image. Redbeard is permitted to record my voice or image during the Ride, and can use those recordings without limitation or payment to me, to promote or market Redbeard.  
  6. Promise to Indemnify and Not to Sue. I promise not to sue or make a demand upon any Releasee on a claim released or waived by me. If I or anyone on my behalf makes such a suit or demand against any Releasee, I will defend and indemnify that Releasee against any resulting liability or expenses, including attorneys fees.  
  7. Full Agreement. This agreement contains the entire agreement between me and Redbeard, and cannot be modified except in writing. I agree to submit any dispute arising under this agreement or from my participation in the Activity to arbitration pursuant to the American Arbitration Association’s Commercial Arbitration Rules. If any portion of this Agreement is held to be invalid, the rest of the agreement shall continue in full force and effect. 
  8. Agreement to Be Bound. I have carefully read this Agreement and agree to be bound by it.
